LAS VEGAS, Sept. 22, 2025 /PRNewswire/ -- The United States District Court for the District of Nevada denied efforts by the Clark County School District and the Nevada Department of Education to dismiss a class action lawsuit brought on behalf of students with special needs and their families. This pivotal ruling means the case will move forward, allowing families to pursue claims that the district's systemic failures have denied thousands of children their right to a free and appropriate public education under federal law.

The lawsuit alleges that longstanding district-wide policies and practices have left students with disabilities without the services and supports they are entitled to under the Individuals with Disabilities Education Act, Section 504 of the Rehabilitation Act, and the Americans with Disabilities Act. The Court's order recognizes the seriousness of these allegations and affirms that families deserve their day in court. At stake are the futures of more than 40,000 children in Nevada's largest – and the nation's fifth largest -- school district. These students have been deprived of essential opportunities to learn, grow, and thrive.

Plaintiffs' Legal Team Statement (Lori Rogich, Hillary Freeman, Greg Little, Catherine Merino Reisman, Jeffrey Wasserman, Courtney McCandless, and Judith Gran):

"We are gratified that the Court recognized the importance of these claims and refused to let procedural barriers prevent families from seeking justice. This ruling is an important step, but the work continues. We look forward to presenting the evidence and fighting to ensure every child with special needs in Clark County receives the education they are guaranteed by law," said the legal team in a joint statement.

As the case moves forward, the plaintiffs and their counsel remain unwavering in their commitment to pursue justice, accountability, and lasting change for children with special needs in Clark County.
